What is Litigation?

Litigation is a general term and can be used to describe various types of disputes before the courts.

Civil litigation, meaning litigation without a criminal aspect, concerns litigation between individuals or companies, conducted in the civil courts. The courts which hear civil litigation cases in Ireland are:

  • The District Court

  • The Circuit Court

  • The High Court

  • The Commercial Court

The Court of Appeal, established on 28th October 2014, occupies an appellate jurisdictional tier between the High Court and the Supreme Court. The decision of the Court of Appeal is final unless the Supreme Court permits an appeal under Article 34.5.1 of the Constitution.

Generally speaking, the Irish Supreme Court is only involved in civil litigation when it has permitted an appeal.

High Court civil litigation usually involves disputes concerning large sums of money or complex matters. There is no monetary limit to bringing a civil litigation claim in the High Court although cases falling within the monetary jurisdiction of the Circuit or District courts will appear in those courts. There is no upper limit on awards which can be made in the High Court.
