What are your options?

In any family dispute, minimising the damaging and costly effect of protracted litigation and Court appearances is very important. We believe that it is essential to explain the Court process carefully to our Clients so as to reduce the anxiety that can so often surround Court appearances and to be able to address concerns.

We adopt a calm and measured approach to family litigation, while at the same time focusing on issues with a view to de-escalating conflict. We believe that family proceedings need to be dealt with in a measured and considerate manner so as not to exacerbate an already difficult situation, especially if there are young children involved. We promote the importance and benefits of co-parenting for children and the necessity of putting the welfare of children at the centre of all interactions, so as to maximise the potential of parents to co-parent successfully following separation.

There are some disputes that cannot be resolved other than through the Courts system which is available to family law litigants. However, many disputes have in our opinion every likelihood of being resolved through one of the processes involved in ADR. Alternative Dispute Resolution (ADR) is a method of resolving issues without recourse to the Courts. It comes in many formats such as Mediation, Collaborative Practice, Structured Negotiations and Restorative Justice.

Why ADR?

At Eoin C. Daly Mallon LLP we see the various models of ADR as being robust and valuable alternatives to traditional adversarial litigation. This is particularly so in disputes which will require the parties, notwithstanding the issues of the dispute, to remain in close contact with one another post separation. For example, separating parents, who despite the separation, will still need to co-parent into the future, having the best interests of their children at heart.

Similarly, in succession disputes, where families are at loggerheads regarding the provisions of a will for example, adversarial litigation can render those fragile relationships beyond repair. ADR, on the other hand, seeks to preserve the best aspects of what remains without making matters worse and attempts to enable the parties to reach a resolution which is acceptable to all sides.

It is also cost effective and transparent option for couples to resolve their disputes. These models are all based on enabling parties to craft their own solutions with help, advice and support and can lead to deep resolutions as opposed to the shallow peace, which can so often be the result of litigation.
